Terms of Use (CarryWay Service)

1. General Provisions
These Terms of Use (the “Terms”) constitute a legally binding agreement between you and
Aleksandr Vasilyevich Dolgov (the “Operator”, “we”, “us”, “our”), a citizen of the Russian Federation
residing at 2704 Ocean Ave, Brooklyn, NY 11229, USA, and govern your access to and use of the CarryWay
mobile application for Android and iOS (the “App”) and the website located at
https://carryway.tech (the “Website”, together with the App, the “Service”).
The App is available for download only from official stores (Apple App Store for iOS and Google Play for Android).
The Website is an informational and promotional resource where you can find information about the Service,
these Terms, the Privacy Policy and contact forms.
By registering in the App and/or by accessing or using the Service in any way, you accept and agree to be
bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Service and delete the App.
CarryWay is designed for adult users (18+) worldwide and provides a platform for users to publish listings for trips
(flights and other journeys) with the possibility of carrying packages (envelopes with documents, hand luggage, baggage,
oversized items). CarryWay is not a carrier, freight forwarder, postal operator, courier company, travel agency,
employment agency, financial intermediary or customs broker.
The Service does not provide booking, payment, insurance, storage, customs clearance or actual transportation services.
All arrangements regarding transportation, reimbursement of expenses, payments, meetings and similar matters are made
directly between users, either in the in-app chat or outside the Service.
The Operator is not a party to any agreements between users and is not responsible for their performance,
including compliance with the laws of countries in South America, Turkey, Thailand, Vietnam, Indonesia,
North African countries (including Arabic- and French-speaking jurisdictions), the European Union, the United States and any other states.
2. Definitions
For the purposes of these Terms:
- Service means the CarryWay App and the Website, collectively providing functionality for publishing and searching Listings and exchanging messages in the Chat.
- User means an individual who is at least 18 years old, has full legal capacity, has registered in the App and uses the Service in accordance with these Terms.
- Visitor means any person who views the Website and/or Listings without registering in the App.
- Listing means information about a trip published by a User (the Carrier), including the route (place of departure, date/time of departure, place of arrival, date/time of arrival, including possible segments and transit countries), type of package (envelope, hand luggage, baggage, oversized) and at least one category of goods.
- Package means cargo handed over for transportation under arrangements between Users (envelope – documents only; other types – with one or more selected categories of goods).
- Chat means the in-app messaging function used by Users in relation to a specific Listing (between the owner of the Listing and interested Users).
- Carrier means a User who publishes a Listing about a trip and potential carriage of packages.
- Sender means a User who hands over a package to a Carrier for transportation.
- Prohibited Items means any goods whose carriage or circulation is prohibited under the applicable laws of the country of departure, any transit country or the country of destination, as well as under international aviation and trade rules (including, without limitation, IATA/ICAO Dangerous Goods Regulations and other aviation, customs, export-control and sanctions regimes).
3. Registration, Account and Age Restriction
3.1 Eligibility
- The Service is intended only for individuals who are at least 18 years old.
- Registration by minors is strictly prohibited.
- By registering and using the Service, you confirm that:
- you are at least 18 years old;
- you have full legal capacity to enter into binding agreements;
- your use of the Service does not violate the laws of your country of residence or of any country of departure, transit or destination of your routes.
3.2 Account Creation
You can register and create an account using your Apple ID, Google Account or an email address with a verification code.
You must provide accurate and up-to-date information (such as your name, surname and date of birth) and keep it updated.
The Operator may request identity documents or additional data where required by law (for example, for anti-money-laundering
and counter-terrorist-financing rules, migration or aviation regulations).
You are responsible for keeping your login credentials confidential. All actions taken through your account are deemed to be performed by you.
3.3 Suspension and Termination
We may temporarily suspend, restrict or permanently terminate your account or access to certain features of the Service,
without prior notice and without compensation, if:
- you breach these Terms or the Privacy Policy;
- we reasonably suspect fraud, illegal transportation or violation of any applicable law (including customs, sanctions, aviation, tax or export-control laws);
- we receive requests or orders from competent authorities (including law-enforcement and customs authorities in Russia, South American countries, Turkey, Thailand, Vietnam, Indonesia, North African states, the EU, the USA or other jurisdictions);
- you provide false or misleading information.
You may delete your account in the App at any time. Account deletion does not relieve you from liability for actions taken before deletion and does not prevent the Operator or public authorities from using stored data as permitted by law.
4. Use of the Service
4.1 Publishing Listings
- As a Carrier, you may publish Listings for trips indicating the route (including segments and transit countries), dates and times, types of packages and categories of goods, as well as limits on weight, size and quantity.
- For the “envelope” type only the “documents” category is allowed.
- For other types, you select one or more categories from the list (for example: documents, marketplace goods, electronics, spare parts, cosmetics, food, alcohol, tobacco, sports equipment, pets, etc.).
- You are solely responsible for the accuracy, completeness and legality of all information in your Listings.
4.2 Prohibited and Restricted Items
You may not use the Service to ship, carry, arrange, promote or otherwise facilitate the carriage of any items that are prohibited
or restricted under the laws of the country of departure, any transit country, the country of destination, or under international aviation
and trade rules. You are solely responsible for identifying and complying with applicable restrictions before each trip.
At a minimum, and without limitation, the following are considered Prohibited Items:
- Illegal drugs and controlled substances — including narcotics, psychotropic substances, precursors, medical or recreational cannabis, THC/CBD products and any substances controlled under the laws of South American countries, Turkey, Thailand, Vietnam, Indonesia, North African states, the EU, the USA and other jurisdictions.
- Weapons and ammunition — firearms, parts and components, ammunition, explosives, detonators, fireworks, flares and similar devices.
- Explosive, flammable, oxidizing, corrosive and other dangerous goods — such as gasoline, fuel, gas cylinders, aerosols, certain paints and solvents, corrosive chemicals, toxic and infectious substances, radioactive materials, strong magnets and large lithium batteries, as regulated by IATA/ICAO Dangerous Goods Regulations.
- Cash and monetary instruments — banknotes, coins, traveler’s checks, bearer securities, bullion, uncut precious stones and any schemes intended to circumvent currency-control or AML/CFT rules.
- Stolen, counterfeit or otherwise illegal goods — including counterfeit brands, pirated software, goods infringing intellectual property rights and items obtained by crime.
- Hazardous biological and medical materials — infectious samples, diagnostic specimens, non-approved medicines, psychotropic medications without prescription or authorizations, vaccines outside legal distribution channels.
- Live animals (unless explicitly permitted by applicable law and accompanied by all required veterinary and transport documents), as well as protected wildlife, illegal hunting products and ivory.
- Food and agricultural products that are banned or restricted by sanitary, veterinary or phytosanitary rules of the country of departure or destination (meat, dairy, plants, seeds, soil, etc.) where necessary certificates are missing.
- Pornographic materials and content prohibited by local morality or religious norms, including child pornography or any material criminalized in Islamic and other jurisdictions.
- Cultural property and antiques subject to export bans or licensing requirements, as well as goods restricted by export-control, sanctions and embargo regimes (including UN, EU, US OFAC and local sanctions regimes).
- Any other items that are prohibited to import, export, transit or ship under the laws of South American countries, Turkey, Thailand, Vietnam, Indonesia, North African states or any other applicable jurisdiction.
This list is not exhaustive. Before accepting or handing over any package, you must verify all applicable national rules
(customs lists of prohibited and restricted goods, aviation rules, sanitary and veterinary requirements, sanctions lists, etc.)
using official sources or qualified advisers.
4.3 Carrier’s Responsibility
The Carrier is fully and solely responsible for:
- physically inspecting packages and verifying that they do not contain Prohibited Items;
- complying with the laws of the country of departure, all transit countries and the country of destination
(including customs, currency, sanitary, veterinary, aviation, migration, export-control and sanctions rules);
- ensuring that all required permits, declarations, certificates and other documents are in place for the goods carried
(including animals, medicines, electronics, high-value items);
- any fines, penalties, confiscations and civil, administrative or criminal liability arising from carriage of packages.
4.4 Sender’s Responsibility
The Sender is fully responsible for:
- the lawful origin and circulation of the goods placed in the package;
- ensuring that the package does not contain Prohibited Items and complies with applicable restrictions;
- providing the Carrier with accurate information about the contents, value, handling conditions and all supporting documents.
4.5 Chat and User Interactions
In the Chat, Users must not:
- engage in fraud, extortion, money laundering, sanctions evasion or assist in such activities;
- send threats, insults, extremist, hateful, violent or otherwise unlawful content;
- disclose personal data of third parties without a legal basis;
- send spam, advertising or any messages not related to a specific Listing;
- discuss or promote methods to bypass customs, aviation, currency or other regulatory controls.
The Operator may use automated and/or selective monitoring of Chats to detect violations, ensure technical support
and protect its legitimate interests, and may disclose Chat content and related data to competent authorities upon request
or where we reasonably suspect unlawful activity.
5. Financial Conditions
- The Service is provided to Users free of charge.
- The Service does not provide payment functionality and is not a payment service provider, bank, e-wallet, money-transfer system or other financial intermediary.
- All payments and reimbursements between Users are made directly outside the Service. We do not control, process, guarantee or assume any responsibility for such payments.
6. Cancellations
You may delete your Listings or stop communicating in the Chat at any time.
The Operator has no responsibility for cancellation of arrangements, no-shows, loss or damage of packages, or any other consequences
of interactions between Users.
7. User Conduct
7.1 User Obligations
By using the Service, you agree to:
- comply with all applicable laws of your country and of all countries forming part of your route;
- use the Service only for lawful purposes;
- provide true, accurate and complete information when registering and publishing Listings;
- refrain from using the Service as a professional business in violation of licensing, tax, transport or similar requirements,
unless such use is clearly allowed under applicable law;
- respect the rights of third parties (including intellectual property and privacy rights);
- not attempt to hack, decompile, disable or bypass any technical protection measures of the Service.
7.2 Violations and Enforcement
If you breach these Terms or the law, the Operator may:
- remove your Listings and other content;
- restrict or block access to your account;
- retain and use data to protect our legitimate interests;
- disclose relevant data to competent authorities in Russia, South American countries, Turkey, Thailand, Vietnam, Indonesia,
North African states, the EU, the USA and other jurisdictions in accordance with law.
8. Intellectual Property
All rights to the Service (source code, design, databases, texts, logos, trademarks and other content) belong to the Operator
or are lawfully licensed. You are granted a limited, personal, non-exclusive, non-transferable license to use the Service
for your own non-commercial purposes.
You must not copy, modify, distribute, sell, reverse engineer or otherwise use any elements of the Service
for commercial purposes without our prior written consent.
9. Disclaimer and Limitation of Liability
- The Service is provided “as is” and “as available”, without any express or implied warranties.
- We do not warrant that the Service will be error-free, uninterrupted, secure or meet your expectations, or that it will be compatible with your devices.
- We are not liable for:
- acts or omissions of Users, including violations of any law;
- contents of packages, or their loss, damage, delay, seizure or destruction;
- any agreements between Users, including payments, insurance or reimbursements;
- any direct, indirect, incidental, special, punitive or consequential damages arising out of or in connection with your use or inability to use the Service.
- To the maximum extent permitted by law and unless caused by our wilful misconduct, our total aggregate liability in connection with the Service is limited to 1,000 Russian rubles (or equivalent in another currency at the date of claim).
10. Termination of Use
You may stop using the Service and delete your account at any time.
We may unilaterally terminate or restrict your access to the Service if you breach these Terms, if we suspect unlawful activity,
or where required by law.
11. Changes to the Terms
We may amend these Terms from time to time. The updated version will be published on the Website and will take effect upon publication,
unless otherwise specified. Your continued use of the Service after the updated Terms are published constitutes your acceptance of them.
12. Governing Law and Jurisdiction
Unless mandatory laws of your country of residence provide otherwise, these Terms are governed by the laws of the Russian Federation.
Any disputes shall be submitted to the court at the Operator’s place of residence, unless mandatory consumer-protection rules
of your jurisdiction require a different forum. Nothing in these Terms limits your rights under such mandatory local laws.
